oh yeah make sure you send those in in
0:08
the meantime we’re taking a closer look
0:10
at a story we’ve been following this
0:11
morning one of our top stories in fact
0:13
four NHL players are facing sexual
0:15
assault charges in connection with that
0:17
2018 incident at a hockey cada Gala a
0:20
fifth former nhlers surrendered to
0:22
police over the weekend is also facing
0:24
charges there are questions about how
0:26
the trial will play out who else could
0:28
be involved once it does go to court
0:29
joining us this morning with more is
0:31
Tanya Walker a lawyer and managing
0:33
partner with Walker Law welcome back to
0:34
your morning thank you for having me
0:36
great to see you there’s a lot of things
0:38
we don’t know yet and we are getting an
0:39
update from London Police on Monday and
0:42
important to note that these four NHL
0:44
players still have not turned themselves
0:45
in so we don’t know specifically what
0:47
the charges are but we also know that
How could this affect this case
0:49
Ontario’s court system is dealing with
0:51
significant delays that come from staff
0:53
shortages how could this affect this
0:55
case well we still have to adhere to
0:58
their Charter which is section 11 B
1:00
which provides that in the case of RN
1:02
Jordan that a trial a criminal trial
1:04
must go to trial within 30 months um if
1:08
you take into account any other delays
1:09
but straightforward it’s 30 months we
1:12
also have to take into account that uh
1:13
five people could be could be charged
1:15
separately um and that could rent result
1:18
in five separate trials and what would
1:20
probably make more sense in use of
1:22
judicial resources um is to have if
1:26
there is a trial all of them tried
1:28
together at once so then the accused
1:30
don’t have to testify many times and
1:32
neither does a
1:33
complainant the alleged victim in this
Who is the alleged victim
1:36
case we know is identified only as em in
1:38
court documents uh you know one of the
1:41
one of the requirements is that em
1:43
remain unnamed does that become more
1:45
difficult once this case enters the
1:47
courts I don’t think so I mean it’s up
1:49
to the court but the court can um render
1:51
a publication ban which provides that
1:53
her name is not to be provided and I
1:55
would not or published um without
1:58
serious ramifications and I wouldn’t be
2:00
surprised if that happens in this
2:01
situation uh what what could this mean
What could this mean for other players
2:03
for other members of the 28 World Junior
2:06
Team could they be called to testify
2:07
would they be brought in as as part of
2:09
this trial once it does head to court
2:12
well they could be called in to testify
2:14
even if they a person does not volunteer
2:16
there are they that person could be
2:18
summonsed but my experience with civil
2:19
trials is that Witnesses are that are
2:22
summoned usually don’t want to really be
2:24
there and and not may not make the best
2:26
Witnesses but there is a chance that uh
2:28
they might be summonsed uh they there
2:30
could be more people that um are charged
2:32
with a crime as more information comes
2:35
out and uh developments unfold uh we
2:38
will only see what will happen in the
2:39
future we saw a lot of people when uh
2:42
this went before parliamentary committee
2:44
we did see a number of people
2:45
interviewed including people from the
2:46
overseeing bod such as Hockey Canada and
2:49
Canada hockey could we also see members
2:51
again come back to court once this goes
2:54
to trial it depends on what they’re
2:56
going to testify about because my
2:58
understanding is that this is an
2:59
incident that happened after um they
3:02
received they won the world hockey um
3:04
championship and so what Witnesses were
3:07
around during that period of time um
3:10
that could speak to what what has
3:11
happened um maybe even afterwards but
3:14
really what happened during that time so
3:15
just depends on who was there at that
3:17
function at that time um what are the
Rights for a victim
3:19
rights for a victim in a case like this
3:21
do they have to testify do they have to
3:23
be cross-examined do they have to speak
3:25
at all I’m not sure uh because I
3:28
practice mostly civil law uh I would
3:30
think that this person the com the
3:32
accused I mean sorry the complainant or
3:35
the victim would have to testify um I
3:39
don’t know if the there would be a
3:41
summons for that person to testify but
3:43
usually when you do testify you can be
3:45
subject to
3:46
cross-examinations and so that is um a
3:49
risk that um may be taken teny Walker I
