province in line with most other
0:01
jurisdictions in this country critics
0:03
worry about how fast the courts appear
0:05
to be moving forward with a change that
0:06
could become permanent lawyer Tandy
0:08
Walker is joining me now to discuss good
0:10
morning to you nice to see you good
0:12
morning thank you for having me okay so
0:14
let’s start off with the benefits of
0:15
jury trials and civil cases and the
0:17
downsize talk to us about that well the
0:19
benefits of jury cases that you are
0:21
judged by your peers and so really that
0:24
is the main benefit there are many
0:26
disadvantages what is that they’re just
0:29
not enough judges to deal with trials
0:31
and jury trials take a little bit longer
0:33
because it takes time to explain to
0:34
legal principles and as a result you
0:37
don’t have as many cases being put
0:39
through say the pipeline another
0:41
disadvantage is the cost there’s a high
0:44
cost to people who are paying their
0:47
lawyers for a jury trial because the
0:49
jury trial takes longer another problem
0:52
is that now is to the lip delay there
0:55
there aren’t they are not dealing with
0:57
any jury trials at the moment until at
0:59
least September and we don’t know when
1:01
that will actually end up and you want
1:03
to quite a few disadvantage so you’ve
1:05
said that you want to see Tana the
1:06
province slowed down on making these
1:08
kinds of changes right now how come I
1:11
don’t believe a permanent change is
1:13
necessary
1:14
my thoughts are you can get rid of jury
1:18
trials at the moment see how it turns
1:21
out
1:21
when colvett 19 is over there’s a
1:24
vaccination it’s able to be
1:25
mass-produced then you can say okay is
1:27
this something that we should continue
1:29
on or we do we need to go back to jury
1:31
trials because it is important for
1:34
access to justice to be had to have the
1:37
option to be judged by your peers the
1:40
only province where there is no jury
1:42
trial at all for civil cases is Quebec
1:45
every other province you have the right
1:48
at least to ask for a jury trial since
1:51
1990 the Ministry of the Attorney
1:53
General reports the backlog of civil
1:55
trials across the province has doubled
1:57
if we don’t eliminate jury trials Tanya
2:00
how can we alleviate this backlog in the
2:02
longer term my thoughts are technology I
2:06
have access to technology where a juror
2:09
is able to participate in the trial from
2:12
at home that’s the only
2:13
reason but I really think that trials
2:17
that are scheduled by jury at the moment
2:19
the civil trials it really should be
2:21
dealt with by a judge because the
2:23
backlog is gonna be tremendous yeah I
2:25
can’t even imagine and one of the things
2:26
you just mentioned quick access to
2:28
justice that’s being compromised because
2:30
of the delays during this pandemic talk
2:32
to us about not only the the cost for
2:36
the cost but also other issues with that
2:38
problem
2:39
another issue other issues with that
2:41
problem is that our witnesses the
2:44
memories fade so by the time you
2:45
actually get to trial your witness might
2:48
not be around or might not even remember
2:50
what happened
2:51
you have spoilage of evidence that’s a
2:53
possibility you know there’s so many
2:55
issues that you can have and therefore
2:58
you may not get the access to justice
2:59
that you really deserve jury trials you
3:02
don’t really have a right to it it’s not
3:04
in the Charter of Rights and freedom as
3:06
it is with criminal trials where you
3:08
might have a sentence of more than five
3:11
years and section 13 s protects you and
3:13
allows you to get a jury trial and also
3:16
you with a criminal trial you’re
3:18
supposed to try that within a certain
3:19
period of time that’s not the same for a
3:21
civil trial you can have up to five
3:23
years I’ve actually had trials where
3:25
it’s taken five years to get the trial
3:27
and it’s very difficult to find the
3:29
witnesses to get them to testify it’s a
3:32
it’s a headache so I really think in
3:35
terms of access to justice elimination
3:38
just temporary elimination of jury
3:40
trials should be considered and then
3:42
reevaluate that in a year or so to see
3:44
if that should be a permanent change
3:46
Tanya Walker always good to see you
3:48
thanks so much for your insight thank
3:50
you for having me all right
